CONTRACTED PAGE

Includes all services described in selected package details reviewed and distributed to clients. Any additional services/products requested by the client incurred by consultant will be billed directly to client at cost. All services contracted cannot be deducted, but additional services can be added.

RELATIONSHIP: WEDDING PLANNER/ CLIENTS

 This agreement contains the entire understanding between Katrina Saw (Planner) and the CLIENT. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all the parties.

Client’s obligation: Client is responsible for certain deadlines such as selecting the location, choosing a date, wedding theme, seating chart,  dinner and hotel reservations. Planner has the authority to make last minute changes and will find comparable items that are within budget. 

PAYMENT & RESERVATION

Service(s) provided are for the dates and details listed on this agreement.

Client is responsible for paying any and all vendor charges and venue fees.

The Client agrees to pay 30% nonrefundable deposit required to secure your date at the time of booking. Deposit due at time of signing. Another 30% of the total is due 90 days prior to the wedding/event. 100% of the remaining balance is due 14 days from the day of the wedding/event. If you fail to pay as per the terms of this Agreement, your past-due account will be charged at a rate of two percent (2%) per month, compounded.

ALL INCLUSIVE ELOPEMENT SERVICE PAYMENT AND RETAINER

The Client agrees to pay 50% nonrefundable deposit required to secure your date at the time of booking. Deposit is due at the time of signing. 100% is due 14 days prior to Elopement date.

For your convenience, payments can be made online via HoneyBook.com using a valid credit card. Retainer Fee may be paid via credit card and subject to the payment requirements as stated above (subject to an additional 3.5% credit card transaction fee).  Otherwise, payment is to be made by cash or check.

Deposits and payments are accepted via check (Attn: Katrina Saw, Memo: K. Saw Weddings), Venmo (@ksaw84). There is a $25 charge for checks returned by the bank for any reason. 

PENALTY FEES & CHARGES

There will be a $35 late payment fee for any payments that are not postmarked or delivered to the Photographer by the required date.

OVERTIME CHARGE

K. Saw Weddings will work for allocated amount of time listed above, not to exceed 8 hours in accordance with overtime laws. Hours added on the day of the wedding itself will be charged at a rate of $150 per hour after the first 8 hours (charged in increments of 1/2 hours).

Additional unplanned and/or un-contracted services (such as, but not limited to, full redo of design, day of event extension of time, services outside of scope of agreement, management of non wedding day activities, etc) are considered overtime and will be billed with prior notification and consent at the rate of $150 per hour.

Any purchased items on behalf of client for day of event or prior will be billed directly to client at cost of goods and mileage at $1.00 per mile if extensive travel (beyond 25 miles) is required to be acquired.

CONTRACTED VENDORS AND PAYMENTS

Any rentals and/or subcontracted vendors contracted on behalf of client will be paid in full to rental companies and/ or subcontracted vendors directly at requested deadline. Proper notice will be provided per cost.

DAMAGE AND LOSS OF ACCESSORIES

Client agrees to exercise all due care in caring for, and preserving the property of  Planner. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost.

LIABILITY

It is understood that Planner is only liable for services completed and provided by Planner and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Consultant be liable for consequential damages of any kind.

CANCELLATION & POSTPONEMENT

In the event of your cancellation of this event/wedding, and/or your request and/or cancellation of our goods and/or services, the deposit of this Agreement and any travel fees already incurred will be retained and any payments made over the deposit & incurred travel fees will be refunded to the client. 

If the event and/ or wedding is cancelled 2 months prior to your event and/ or wedding date 75% of all the expenses and service fees incurred. 

K. Saw Weddings reserves the right to cancel this Agreement at any time (in case of emergencies or acts of God) prior to the wedding/event date and will make a full refund of your deposit. If this Agreement is enforced against you, you will pay all expenses incurred by us, including but not limited to: attorney’s fees, filing fees, court costs, interest, consequential damages, etc. If the Client postpones their original wedding date, the initial retainer fee is valid for up to 12 months to reserve a new wedding date.

*COVID-19 OR OTHER PANDEMIC SAFE BOOKING*

  In the event of an unforeseen pandemic should occur and any government agencies recommend events to be limited in attendance or have any other recommendations which would affect the original plans of the client’s event, Wedding Planner will reschedule the event within 12 months of the original date.  In this case, any change fees or penalties normally applicable with Wedding Planners will be waived.  The Wedding Planner will provide the guidance to the client in negotiating and rescheduling the venue and vendors already booked.  While the planner will make every effort to provide the services booked in the original package regarding negotiating and rescheduling the other vendors and venue already booked, there may be additional fees in providing duplicate work already included in the client’s package.  The client can also have Wedding Planner handle this for them (DO-IT-FOR-YOU) for a small additional fee (if this wasn’t something already included in the original package). Any additional fees will be determined and agreed upon at the time of rescheduling the event. 

Due to COVID-19, Client agrees to require their guests to wear masks during the ceremony and reception except during mealtimes (cocktail hour, lunch and or dinner).

Client agrees to enforce social distancing between guests and vendors present at the event/ or ceremony. 

Planner will provide a COVID-19 screening form to the Client and hired vendors who will be present at the event and/or wedding. A signed form must be returned to the planner on a scheduled date prior to the event and/ or wedding. The Client agrees that these forms should be provided to their guests to ensure safety. Planner is not not liable for guests’ refusal to submit the required form. 

RIGHT OF WITHDRAWAL

The Planner’s discovery of new information, changes, or other factors tending to circumvent its policies could result in its withdrawal. Non-­cooperation, changes of locations, facilities or times available, missed appointments, bad or returned checks, or late payments are examples of contributing factors. Should the Planner initiate the withdrawal, the Client will not be billed for any services in excess of their retainer fee (except if retainer fee was in form of returned checks). In case of withdrawal, 50% of the retainer fee will be refunded back to the client. 

SEVERABILITY

If any provision of this agreement is held to be invalid or unenforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and in effect.

TRAVEL

Weddings that require extensive travel will incur expenses such as lodging, airfare, mileage, and meals. Travel and accommodation fees are applicable for any meeting locations or venues requiring more than 100 miles from Planner’s home in San Francisco, CA. Travel and accommodations will be booked by Planner and billed to client with proof of purchase/receipts. After 100 miles roundtrip, a travel fee of $1.00 per mile is subjected for the additional miles traveled. Travel by car greater than 240 miles roundtrip requires hotel accommodations for two nights and a $100 meal fee in addition to the $1.00/mile travel fee (after 100 miles roundtrip). For engagement sessions, 40 miles roundtrip is included in the package. After 40 miles roundtrip from The Planner’s home, a travel fee of $1.00 per mile is subjected for the additional miles traveled.

PARKING

Should the engagement location(s) and/or wedding venues charge parking fees, the Client is responsible for the Planner(s) expenses. Parking fees will be invoiced to the Client immediately after the event is over and is due two weeks from the invoice. 

VENDOR MEALS

Vendor meal(s) must be provided for events with 4 or more hours of coverage for all the K. Saw Weddings team. Final meal count to be confirmed 1 month from event date. If the Client does not provide such meals, the Client agrees to reimburse the Planner (s) for meal expenses in addition to a one hour overtime charge of $150. The Planner require that she and her assistant are served their meals the same time as the bride and groom or have at least 30 minutes to eat in order to avoid delays and missing reception activities.

HOUSE RULES

It is agreed that K. Saw Weddings is not acting as your legal advisor in negotiating and/or executing vendor and/or vendor contracts.

The Client(s) expressly agree(s) to take best efforts to provide Planner and Planner's staff with a safe and appropriate professional relationship. In the event of circumstances deemed to present a threat or implied threat of injury or unprofessional, harassing language or behavior to Planner's staff, Planner will make reasonable efforts to notify the Client(s). If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time, Planner shall resume work in accordance with the original terms of this Agreement. If the inappropriate behavior continues, the Client(s) will agree to relieve and hold Planner harmless as a result of incomplete services under this Agreement, or for a lapse in the quality of the Planner's work. The Client(s) shall be responsible for payment in full, regardless of whether the situation is resolved or whether Planner resumes work detailed in this Agreement.

EXPIRATION

Current event date is valid 1-week post origination date to secure services.

PROVIDED DOCUMENTATION

All documentation created and provided to client is owned and copy written by Consultant and cannot be used or given to any other 3rd party.

SOCIAL MEDIA USAGE

The Client herby grants to the Planner the permission to post any tasteful photos/videos before, during, and after the wedding and engagement event. This is not limited to Facebook, Instagram, Twitter, Snapchat, etc.

MODEL RELEASE

The Client hereby grants to the Planner and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the Client or in which the Client may be included, for editorial, social media, trade, advertising, and any other purpose and in any manner and medium to alter the same without restriction and to copyright the same. The Client hereby releases the Planner and her legal representatives and assigns from all claims and liability relating to said photographs. Should the Client wish to opt out of the model release and not be publicly published in the Planner’s portfolio, blog, and social medias, they may do so unless a consent to opt out is signed. 

The undersigned have read this contract, understand its terms, and agree to be bound thereby. Any additions, deletions, or revisions must be made in writing and approved by all responsible parties. The parties agree that this contract is the complete and exclusive statement of the mutual understanding of the parties.
